Union that Hounded Agri Rebuffed by Federal Appeals Court
New York… The Union that had called thousands of Orthodox Jews in Brooklyn and elsewhere with a fictitious claim (confirmed by USDA officials) that food produced by Agriprocessors in Postville, IA was unsafe was rebuffed by a federal appeals court. In another blow to the credibility of the United Food and Commercial Workers (UFCW) International Union, a federal appeals court has overturned a decision by the National Labor Relations Board (NLRB) and ruled that Smithfield’s security personnel did not mistreat employees who worked for a cleaning contractor during a November 2003 protest at its Tar Heel, North Carolina plant. The union has been using the discredited NLRB decision to bolster its claim that Smithfield abused and assaulted employees at the plant. Smithfield Packing Co. is America’s leading pork producer. It produces a variety of pork products – country hams, hot dogs, bacon, deli meat, fresh meat, barbeque, sausage and more – for customers around the world.
The UFCW is the same union that had recently launched a harassment campaign against Agriprocessors in apparent retaliation for the continued refusal of Agri’s employees to come under the Union. The campaign included ads, flyers, and even a chain telephone call under the guise of a food alert. All of the charges by the Union against Agri were false as was corroborated by officials of the United States Department of Agriculture (USDA). Workers at Smithfield Packing also refuse to join that Union, which seems to have a textbook campaign for forcing companies like Agri and Smithfield into submission. ‘These claims were based on false testimony sponsored by the UFCW to make Smithfield look bad,’ said Dennis Pittman, director of corporate communications at Smithfield Packing Co. ‘The union knew these claims were false because there was video tape evidence authenticated by a world- renowned expert demonstrating beyond any doubt that the conduct alleged by the union never happened. Yet the union went ahead with the case anyway.’ The U.S. Court of Appeals for the Fourth Circuit noted that the agency’s failure to consider the video tape evidence as ‘bordering on the absurd.’ The case arises in the context of an ongoing effort by the union to gain support from Smithfield’s Tar Heel employees for union representation just as it is trying to do at the Agri plant in Postville, Iowa. Having lost two previous union elections and despite the fact that the government has ordered that another election be held, the union has refused to participate in another election and has instead waged a corporate campaign against Smithfield.
